(“DressFitt,” “we,” “us,” or “our”), addresses copyright infringement claims and complies with the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. By using the Services, you agree to the terms outlined in this Policy.
1. Overview
DressFitt respects the intellectual property rights of others and expects all users of our platform to do the same. We are committed to complying with the Digital Millennium Copyright Act (17 U.S.C. § 512) and other applicable intellectual property laws. We will respond promptly to valid notices of alleged copyright infringement and will take appropriate action to address such claims.
If you believe that your copyrighted work has been used on DressFitt in a manner that constitutes copyright infringement, you may submit a DMCA takedown notice as described in this Policy.
2. Our Commitment
DressFitt is committed to protecting intellectual property rights and maintaining a platform that respects the creative works of others. Our commitments include:
- Prompt Response: We respond to valid copyright infringement claims within forty-eight (48) hours of receipt of a complete and properly formatted takedown notice.
- Content Removal: Upon receipt of a valid DMCA takedown notice, we will expeditiously remove or disable access to the allegedly infringing material.
- User Notification: We will notify the user who posted the allegedly infringing content and provide them with information about the takedown and their right to file a counter-notification.

3. Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that content on DressFitt infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following information:
- Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed, including the registration number (if applicable) or other information sufficient to identify the work.
- Identification of Infringing Material: A description of the material that you claim is infringing and its location on DressFitt’s platform, including specific URLs or other information reasonably sufficient for us to locate the material.
- Contact Information: Your full legal name, mailing address, telephone number, and email address so that we may contact you regarding your notice.
- Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

5. Counter-Notification
If you believe that content you posted was wrongfully removed or disabled as a result of a DMCA takedown notice, you may file a counter-notification. Your counter-notification must include the following:
- Identification of Material: A description of the material that was removed or disabled and its location on the platform before removal.
- Statement Under Penalty of Perjury: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which DressFitt may be found), and that you will accept service of process from the party who filed the original takedown notice.
- Contact Information: Your full legal name, mailing address, telephone number, and email address.
- Physical or Electronic Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, DressFitt will forward it to the original complainant. If the original complainant does not file a court action within ten (10) to fourteen (14) business days, DressFitt may restore the removed material.
6. Repeat Infringers
DressFitt maintains a policy of terminating the accounts of users who are repeat copyright infringers. We will, in appropriate circumstances, disable and/or terminate the accounts of users who have been identified as repeat infringers. A “repeat infringer” is a user who has been the subject of more than one valid DMCA takedown notice.
We track all DMCA takedown notices and counter-notifications to identify patterns of infringement and take appropriate action.
7. AI-Generated Content
DressFitt’s AI-powered tools generate images and visual content using machine learning models. The following considerations apply to AI-generated content and intellectual property:
- Style References: AI-generated images may reference general fashion styles, trends, and aesthetics. These references to broad stylistic elements do not constitute copying of specific copyrighted works.
- No Direct Copying: Our AI models are designed to generate original content and do not reproduce specific copyrighted images, designs, or other protected works.
- User Responsibility: Users are solely responsible for how they use AI-generated content, including ensuring that their use does not infringe upon the intellectual property rights of others.
- Input Content: Users must ensure that any images or content they upload to the platform for AI processing do not infringe upon the copyrights or intellectual property rights of third parties.
8. Changes to This Policy
DressFitt reserves the right to update or modify this Copyright / DMCA Policy at any time, at our sole discretion. Changes will be effective upon posting the revised Policy on our website. Your continued use of the Services after such changes constitutes your acceptance of the updated Policy.
